CalNote - Terms of Use

1. Acceptance of Terms

By downloading, installing, or using CalNote (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User") and the developer of CalNote ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

2. Description of the App

CalNote is an Android application that allows users to log food and nutrition information through natural-language text input. The App uses AI-powered analysis (including third-party AI services) to parse food descriptions and estimate nutritional values.

CalNote is intended for general wellness and informational purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

3. Eligibility

You must be at least 13 years of age to use CalNote. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.

4. Accounts and Access

4.1 Account Creation

You may be required to create an account to access certain features of CalNote. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.2 Free Trial

CalNote offers a limited free trial that includes up to 20 AI-powered meal analyses or 48 hours from the date of first use, whichever comes first. After the trial period expires:

  • Access to AI meal analysis features will be restricted.
  • A paid subscription is required to continue using premium features.
  • Free trial limits are enforced per device and per account. Resetting, reinstalling, or creating new accounts to circumvent trial limits is strictly prohibited.

5. Subscriptions and Payments

Certain features of CalNote are available through a paid subscription. Subscriptions are managed and billed through Google Play and are subject to Google Play's payment terms.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Google Play account settings.
  • We do not issue refunds for unused portions of a subscription period, except where required by applicable law.
  • Pricing and features may change with reasonable prior notice.

6. Acceptable Use

You agree to use CalNote only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the App.
  • Attempt to gain unauthorized access to any account, server, or network connected to CalNote.
  • Use automated tools (bots, scrapers, etc.) to interact with the App.
  • Circumvent trial limits, subscription enforcement, or any other usage controls.
  • Use the App to transmit any unlawful, harmful, or offensive content.
  • Resell, sublicense, or commercially exploit the App or its outputs without our prior written consent.

7. AI-Powered Analysis and Data Accuracy

CalNote uses AI models, including Google Gemini, to parse and analyze food descriptions. You acknowledge and agree that:

  • AI-generated nutritional estimates are approximate and may not be accurate.
  • CalNote is not a substitute for professional dietary or medical advice.
  • We are not responsible for decisions made based on nutritional data provided by the App.
  • Results may vary based on how food items are described.

Always consult a qualified healthcare or nutrition professional before making significant dietary changes.

8. Privacy and Data Collection

Your privacy is important to us. Our Privacy Policy, incorporated herein by reference, explains how we collect, use, and protect your information. By using CalNote, you consent to the data practices described in our Privacy Policy.

CalNote may collect data including but not limited to: food log entries, device identifiers (Firebase Installation ID), usage statistics, and account information. This data is used to provide and improve the App, enforce trial/subscription limits, and ensure security.

9. Third-Party Services

CalNote integrates with third-party services, including but not limited to:

  • Firebase (Google) - authentication, database, and cloud functions
  • RevenueCat - subscription management
  • Google Gemini - AI food analysis

Your use of CalNote is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of third-party services.

10. Intellectual Property

All content, design, code, trademarks, and materials in CalNote are owned by or licensed to us and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Nothing in these Terms grants you any right to use our name, logo, or branding without prior written permission.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information provided by the App.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Termination

We reserve the right to suspend or terminate your access to CalNote at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

Upon termination, your license to use the App will immediately cease. Sections 10, 11, 12, and 15 will survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the developer's jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this document. We may also notify you within the App. Your continued use of CalNote after any changes constitutes acceptance of the new Terms.
